Christian Dispute Resolution Services
1 Corinthians 6:1, TLB
Christian Dispute Resolution Services is a method by which Christians can have their disputes, whether small or great, heard and resolved by an experienced Christian Attorney who will base the resolution on both Biblical and legal principals.
Christian Dispute Resolution Services is a preferred alternative to in-court litigation battles for Christians, not only because of the Biblical dictate above, but for other very practical reasons to numerous to list. However, there are three primary problems inherent in the usual litigation process that
should be addressed and exposed. These problems can be avoided and/or resolved by the Christian Dispute Resolution Services Process. They are as follows:
1) The Parties can avoid the unnecessary cost of paying Attorneys fees to two or more different law firms, attempting to fulfill their principal purpose of being an “adversary” one to the other. This adversarial role many times causes Attorneys to take actions (for which the Parties are billed), merely to incite, threaten and/or intimidate the opposition. This type of Attorney conduct is not conducive to resolution of the matter.
2) Most Attorneys have “hourly billing requirements” mandated by their Law Firm Management. Unfortunately, this creates a motive for an Attorney to “pad” bills, double bill, even bill for unnecessary work; or worse, work they never performed. After all, the Attorney must meet weekly and monthly “hourly billing requirements” as set by Management for their Law Firm. The concept is similar to the monthly quotas we all complain about police officers serving in the traffic division, having to meet.
3) Finally, most Law Firms have high overhead, payroll and monthly expenses that must be met. This reality, coupled with those mentioned above, creates an unending cycle of both party’s Attorneys generating thousands of dollars in Attorney’s fees to be paid for by both Parties. Upon reaching conclusion of the matter, it has often been said by the litigating parties, "Only the Attorneys made out."
Resolution: Parties eliminate these two adversarial roles and replace them by agreeing to one impartial Christian Attorney whose goal is to bring a fair, just and reasonable resolution for all Parties and/or their children, as soon as possible. The Parties jointly pay one hourly rate to the Christian Attorney, to hear the dispute, advise them both as to the applicable law and/or scripture references; and to draft any necessary pleadings, agreements and/or documents in order to fully resolve the matter. The Christian Attorney’s primary goal is to use the Word of God and the laws of the State and the Attorney’s negotiation skills and experience to guide and direct the parties to an amicable resolution as expeditiously as possible.
Rules Governing Christian Dispute Resolution Services (“CDRS”)
1) CDRS commences and proceeds on a voluntary basis ONLY. Either Party can stop the Process whenever they desire.
2) CDRS Proceeds at times convenient to all Parties including Saturdays. This eliminates loss of time off work, needless standing around in the halls of the court building and paying two attorneys $350.00 per hour or more.
3) CDRS continues until: (A) A Joint Resolution has been reached; (B) One or more of the Parties wish to end the process; or (C) The Parties reconcile and have no further need for the Process.
4) CDRS uses a Christian Attorney, who is experienced and capable of drafting all types of agreements, settlements, or terms for resolution of the dispute during the Process. Upon conclusion, if litigation is pending, each party can then take the Agreement reached to their own respective Attorneys for review, advice, counsel and further consideration before signing. This aspect of the Process allows each party to pay only a minimal amount to their own Attorney (i.e.) to simply review and advise on the Agreement can be executed and filed with the clerk of the court and the case is resolved. Many times no personal court appearance is required.
5) CDRS reduces the stress and the uncertainty of the outcome of the litigation determined by a Judge who has little time to learn and hear particular
facts of your case and rules on numerous matters every day.
6) CDRS eliminates the stress of preparing to testify in court, the fear of saying the “wrong thing”, of getting on the witness stand and of being cross-examined.
7) CDRS eliminates internal conflict between listening and adhering to the ungodly advice given by the attorney, instead of the Word of God.
8) CDRS eliminates the “mud slinging” found in most court filed documents which become a matter of “public record”; and all communications and interactions during the Resoution process are held confidential as to both parties by the Christian Attorney. Thus providing a certain level of “privacy” of your matter that otherwise would not be available.
9) CDRS is the only means by which the Parties can benefit from the greatest and most expeditious manner possible to arrive at an end to their dispute:
(1) by use of the Word of God to govern and determine “right” vs. “wrong” conduct; and (2) by implementing the “laws of the land” (Romans 13:1-2, TLB) to determine the outcome of a matter based on that conduct.
10) CDRS will bring a conclusion which allows both Parties to move on with their lives more quickly and without carying the bitterness, anger, and resentment which usually haunts litigating Parties for years thereafter.
Christian Dispute Resolution Services Is Not For:
1) Parties who just want to fight and generate as much misery as possible for the other party.
2) Parties who just want another means by which to punish the other
3) Parties who want to use their children to take out their own bitterness and anger on the other parent.
4) Parties who do not want to trust God and obey what God desires of them and would rather take matters into their own hands.
